How to Buy Used Car Insurance for a Car You Just Purchased

You’ve paid for a second-hand car, received the keys, and driven away. The vehicle is officially yours. However, the cover still does not belong to you.

The car’s documents still list the previous owner’s name, so you need to update them within the defined timeline. Generally, there are two steps involved for transferring used car insurance.

The Fourteen Days That Start the Moment You Take the Keys

Section 157 of the Motor Vehicles Act, 1988, has a law that governs vehicles on Indian roads and treats the certificate of insurance as passing to the buyer from the date of sale.

However, just passing is not the same as being recorded. You have fourteen days from that date to apply to the insurer and have the change written into the policy. If you don’t act within this 14-day deadline, you lose the transfer completely.

At the same time, you also need to officially transfer the car’s ownership at the RTO using Forms 29 and 30. The insurance company will typically require proof that you have started this process before they will update the policy to your name.

So it is advised to keep the paperwork together while you are at it. Insurers typically ask for the sale receipt, the old policy, the updated registration certificate or an acknowledgement of the application, and a fresh proposal form carrying your details.

What Does Used Car Insurance Transfer?

The used car only transfers the liability; the other half moves on its own. Third-party protection follows the vehicle, because the law wants an injured pedestrian to have somebody to claim from, regardless of who holds the keys today.

If your car gets damaged, stolen, or has engine trouble, you will have to pay for the repairs yourself until you officially update the insurance policy to your own name.

Many buyers mistake the 14-day deadline for a grace period where they are already covered. In reality, during those two weeks, the part of the insurance policy for cars that covers your own car is not active, so you would have to pay for any repairs yourself.

It’s necessary to update your insurance documents as soon as possible to ensure you are fully covered. If you wait, your car will only be partially protected.

Why Your Renewal Quote Will Beat the Seller’s

No Claim Bonus (NCB) is the discount earned for every year a policyholder goes without claiming. Ownership of that discount sits with the owner and is never tied to the vehicle.

Sellers can request a retention certificate, which parks their earned bonus for three years and lets them carry it to whatever they buy next.

Keep in mind that your insurance renewal cost next year will likely be higher than what the seller was paying, even if you keep the same coverage. This is because you won’t have their ‘No Claim Bonus’ discount. Make sure to consider this extra cost when negotiating the car’s price so it doesn’t come as a surprise later.

Asking the seller in writing whether the bonus is being retained also settles an argument before it starts.

Transfer the Old Policy or Start a Fresh One?

Used car insurance offers two routes at the fourteen-day mark, and the right one depends on the calendar.

Transferring keeps the running policy alive until its original expiry, costs a modest endorsement fee, and usually involves an inspection where a surveyor photographs the car. 

You should only let the current policy expire and buy a new one if it is about to end in a few days. Even in that case, you must ensure there is no gap in your third-party liability coverage, as driving without it is a legal offense, not just a simple administrative mistake.

Check the IDV whichever way you go. IDV is the agreed worth of the car, and under the standard table, a vehicle in its fifth year is valued at half its showroom price, with anything older settled by agreement between you and the insurer. If you take over an old insurance policy with an outdated car value, you will end up with an incorrect payout if you ever need to file a claim.

What Paperwork Cannot Protect You from?

Updating the insurance policy to your name won’t cover any problems from the car’s past. This means that previous accidents, poor repairs, or damage the seller didn’t tell you about cannot be claimed later, even after the policy is officially yours.

Nor does any form hand you the seller’s bonus.

Sellers carry their own risk in all this. Until the records change, tribunals and police still read the old name as the owner, so an unfinished transfer leaves the person who sold the car answering for a crash he had nothing to do with. Used car insurance paperwork protects both sides of the policy. 

You are not covered for damage to your own car during the 14 days before you officially update the insurance. This is why it is so important to complete the transfer within that two-week deadline.

Updating your insurance is an easy and important step. A simple request letter changes the policy into your name, which activates the full coverage for your own car, ensuring you are protected while you drive.
